The Siteand Service are owned and operated by The People Speak LLC (“we” or“The People Speak”). This Privacy Policy details how The People Speak treats thepersonal information it collects and receives. This Privacy Policydoes not apply to the practices of companies or websites that The People Speakdoes not own or control or is not affiliated with or to people it doesnot employ or manage.
If you do not agree to the terms of thisPrivacy Policy, please do not provide The People Speak withany information and do not use the Site or Service.

This Privacy Policy sets forth The People Speak’s privacy practices including:

Information Collection and Use by The People Speak
Ingeneral, you may visit the Site and view content on the Site withoutrevealing any Personal Information or other individual user information(other than cookies as described below). If you want to uploadcontent, join a group or otherwise actively participate in the Serviceand the Site, you will need to become a registered user of the Site.
In connection withcertain portions of the Site and Services, The People Speak will allow users to setup unique personal profiles that can be linked together through groups,friends and other organizations. Each registered user can changehis/her profile information at any time. A user’semail address is not shared or displayed in connection with the Siteunless authorized by such registered user. Users can communicate onthe Site and with each other through the Site, without disclosing theiremail addresses.
The People Speak may also lognon-personally-identifiable information from users of the Site,including IP address, profile information, aggregate user data andbrowser type. This data is used to manage the Site, track usage andimprove the Service. User IP addresses are recorded for security andmonitoring purposes. The People Speak may aggregate thisnon-personally-identifiable information, such as the number of usersthat clicked on a particular link and may share such aggregatedinformation with third-parties to provide more relevant content,services and advertisements to users. Such information will notidentify you individually.
Sharing and Disclosure of Information The People Speak Collects
Exceptas otherwise described in this Privacy Policy, The People Speak will not rent,sell or otherwise disclose your Personal Information to any thirdparty, other than The People Speak’s parent, subsidiaries and contractorsunless you have consented to such disclosure. Notwithstanding theforegoing, The People Speak may disclose Personal Information if The People Speakbelieves that disclosure is necessary: (1) to conform to legalrequirements or to respond to a subpoena, search warrant or other legalprocess received by The People Speak whether or not a response is required byapplicable law; (2) to enforce The People Speak’s Terms of Use or to protectour rights; (3) to respond to claims that any content on the Siteviolates the rights of third parties; (4) to respond to users’ requestsfor customer service; or (5) to protect the safety of users or thepublic. The People Speak reserves the right to transfer Personal Informationin connection with a merger or to a successor in interest that acquiresrights to that information as a result of the sale of The People Speak orsubstantially all of its assets to that successor in interest.
Inaddition, from time to time we contract with other companies, such aswebsite developers, to provide certain services in connection with theSite and Service. In some instances, these contractors may have accessto Personal Information. These contractors are contractually obligatedto maintain the confidentiality of Personal Information and to use itonly for purposes of carrying out the business of the Site. Thesecontractors are prohibited from using Personal Information for theirown marketing purposes or from sharing this information with anyoneother than The People Speak.
The People Speak or a sponsor or alliance maysponsor a campaign, action such as a petition, promotion, sweepstake orcontest on the Site. Users may be asked to provide personalinformation including name, email address or home address or to answerquestions in order to participate. The People Speak may transfer PersonalInformation to certain sponsors, alliances or other third-parties fromwhom you have explicitly requested to receive information. It will beclear at the point of collection who is collecting the PersonalInformation and whose privacy policy will apply.
Children’s Online Privacy Protection Act
The People Speak is a general audience site and does not knowingly collect or solicit orintend to collect any Personal Information from anyone under 13 yearsof age. The Site targets an audience that is over the age of 18 andsome content may not be appropriate for all ages. Parental supervisionis recommended. If you are under 13, please do not attempt to registeron the Site or send any Personal Information about yourself. In theevent that The People Speak learns that it has collected Personal Informationfrom a child under age 13 without verification of parental consent, The People Speak will delete that information as quickly as possible. If youare the parent or guardian of child under 13 and believe that he/shehas disclosed Personal Information to The People Speak, please contact The People Speak using the Contact Us form. Upon request, the parent or guardian of achild under 13 may review and request the deletion of such child’sPersonal Information as well as refuse to permit the further collectionor use of such Personal Information. Invitations and Other Communications to Non-users
Registeredusers can invite friends to join the Service by sending invitationemails via our automated invitation system. The People Speak does not store the emailaddresses that users provide.
Use of Cookies and Other Technology Related Information
Cookiesare small files containing a string of characters sent to your computerthat uniquely identifies your browser. The People Speak uses cookies to storevisitors' preferences and to record session information. These usesinclude serving content recommendations specific to your interests. Wedo not link the information we store in cookies to any PersonalInformation you submit while on the Site, although your password willbe linked to cookies so your password does not need to be re-entered whenyou visit the Site. Most browsers are initially set up to acceptcookies, but you can reset your browser to refuse all cookies or toindicate when a cookie is being sent. However, you must enable cookiesfrom The People Speak in order to use most functions on the Site.
Third-Party Links and Advertising
TheSite may contain links to other third-party websites. The People Speak has nocontrol over the information collected from or about you by anythird-party after you have left the Site. By clicking on links on theSite to other websites, advertisers and other third-parties, you areleaving the Site. Once you have left the Site, The People Speak has no controlover the data collection or other activities of any third-party linkedto the Site. The People Speak is not responsible, and assumes no liabilities,for the privacy policies and/or practices on such other websites. Whenlinking to another site you should read the privacy policy governingthat website. Our privacy policy only governs information collected onthe Site.
Ads or other promotions appearing on the Site may bedelivered to users by The People Speak or one of our sponsors or alliances. Thesponsors or alliances may use cookies if you click on the ad or enterthe promotion. These cookies allow the ad server to recognize yourcomputer each time they send you an online advertisement or othercommunication. In this way, these sponsors or alliances can compileinformation about who saw their advertisements and promotions anddetermine which ads or promotions are clicked on. The People Speak and Third-Party Communications
Users are provided the opportunity toelect or “opt-in” to receiving updates about The People Speak, specific issuesand campaigns, promotional events, subject matters of interest andother communications (“Communications”) from The People Speak and its parentand subsidiaries.In addition, The People Speak may consider requests from unrelatedthird-parties to contact you but we will not give any third-party yourPersonal Information before we have obtained your consent. You maygive this consent by “opting-in” to having your information shared witheach specific third-party. Users who no longer wish to receive suchCommunications from The People Speak or any third-party may choose to “opt-out” at http://thepeoplespeak.com/unsubscribe. In addition,instructions for unsubscribing from Communications will be included inevery email. From time to time and even if you have opted-out ofreceiving Communications, The People Speak will contact you with administrativeupdates or account information, which may include notices relating tochanges in this Privacy Policy or user requirements.
The People Speak uses its good faith reasonable efforts to abide by the policies andpractices laid out in this Privacy Policy and specifically in thisSection on The People Speak and Third-Party Communications. There may beinstances, however, where we inadvertently and unintentionally fail tocomply with these policies and practices. Accordingly, by becoming aregistered user of The People Speak, you hereby agree to receive Communicationsfrom The People Speak and its parent, subsidiaries and third-party affiliates.
Security
The People Speak user accounts will be secured by user-created passwords. The People Speak takesprecautions to ensure that user account information is kept private. Weuse reasonable measures to protect user information that is storedwithin our database, and we restrict access to user information tothose employees or contractors who need access to perform their jobfunctions, such as our customer service personnel and technical staff.However, we cannot guarantee the security of user account information.Unauthorized entry or use, hardware or software failure, accidentaldisclosure and other factors may compromise the security of userinformation at any time.
User Content
Whenyou post User Content on the Site youdo so at your own risk. The People Speak cannot control the actions of otherusers with whom you may choose to share your pages and information.Therefore, we cannot and do not guarantee that User Content you post onthe Site will not be viewed by unauthorized persons. We are notresponsible for circumvention of any privacy settings or securitymeasures contained on the Site. You understand and acknowledge that,even after removal, copies of User Content may remain viewable incached and archived pages or if other users have copied or stored yourUser Content. You also acknowledge that, even after removal, copies ofcontent are retained by The People Speak for legal purposes. This content willnot be visible to users of the Site.
Please be aware thatwhenever you voluntarily post public information to websites, blogs,message boards, chat rooms or any other public forums such informationcan be accessed by the public and can in turn be used by those peopleto send you unsolicited communications.
Changes in Our Privacy Policy
Fromtime to time we may make changes to this Privacy Policy. If we makechanges, we will post the new Privacy Policy (with a new effectivedate) on the Site. All users of the Site are bound by any changes tothis Privacy Policy when she/he uses the Site after those changes havebeen posted. If we are going to use any Personal Information in amanner materially different from that stated at the time of collectionwe will notify by posting a notice on the Site for 30 days.
